Quality Migrant or Permanent Residency

Person who has been ordinarily residing in Hong Kong for more than 7 years is allowed to apply for the Right of Abode in Hong Kong.  This is also known as the Permanent Resident application. On 23rd February 2006 The Government of Hong Kong announced detailed operation of the Quality Migrant Admission Scheme (QMAS).  The scheme is for all Mainland and overseas professionals to settle in Hong Kong. A major difference of seven years residing requirement comes up when we discuss Hong Kong quality migrant program versus permanent residency program,

The main difference between the QMAS and the existing employment visa is that prior employment arrangement is not required for QMAS applicants. After approval of the application, QMAS applicants can take up whatever employment or set up their own companies in Hong Kong.

With successful applications, Hong Kong’s Immigration department will grant 1-year visas initially.  The immigrants will demonstrate that they have taken steps to settle in Hong Kong either by securing employment or by establishing a business before Immigration will consider extending their visas.

By the end of the first 36 months, it is mandatory for the QMAS immigrants to demonstrate that they have obtained gainful employment in a graduate/specialist/senior level job, or by having established a business of a reasonable size here.

The assessment will comprise two phases.  In first phase, applicants will be assessed based on a point test which includes factors like age, academic/professional qualifications, working experience, language proficiency, family connections in Hong Kong, spouse’s achievement, number of dependent children, achievement in a particular field, etc.  A minimum passing mark will be set.

After meeting the requirements and the minimum passing mark, applicants will be ranked according to the scores.  High scoring applicants will be shortlisted to enter phase two for further comparison. Quota will be granted to the most meritorious applicants. Thus quality migrant program differs a lot from permanent residency program. When we see Hong Kong quality migrant program versus permanent residency program the intentions are same but procedures are different. One should opt that process for which he/she is eligible.
